The terms and conditions of this agreement, which are applicable to all uses of the website and are listed below, are accepted and acknowledged by users. Before continuing to use any of the services, all users are required to carefully read, understood, and agreed to all of the terms and conditions. Only those people, groups, businesses, or organisations who are able to commit themselves to agreements under Indian law may use the services. These Terms and Conditions may be modified at any time without any previous notice by Webvyapar. The changes take effect as soon as they are posted.

Definition Clause

User: User of Webvyapar are individuals or companies that have acknowledged the services offered by the website.

Un-authorized Member or User: Un-authorized members or user are those who do not choose to utilize the services. It is necessary for all users to register under the terms and conditions of the company Webvyapar.

Free Services: Free services are offered to any individual or firm that wants to register their business without relying on other website services.

Paid Services: While the most of services are free for users, certain tasks and services need payment. The website's terms and conditions must be accepted in order to use the paid services.

When an individual or a company agrees to use the website's services, the following statements should be adhered to:

• that all the information provided is accurate and reliable according to the provider's best knowledge.
• that it is the user's responsibility to confirm the accuracy of the information provided.
• that the user is at least 18 years old.
• that none of the terms, contents or other information on the website is violated.
• that the user's profile may be terminated or deleted if it is deemed objectionable or violates any contract terms and conditions.
• that the user will not hold the website accountable for any data loss, unexpected events, or user negligence resulting from the use of the website's services.
• Users must use the website in all authorized ways that do not violate local laws. The content used should not be rude or convey a disparaging message.
• The site does not track intellectual property rights. If a user uploads or advertises things that have copyright difficulties, these can be resolved in mutual ways. The site is opposed to the endorsement and promotion of items that may be protected by copyright.
• Issues can arise from content that is not verified in terms of copyright, acknowledgment, knowledge, and violations. For such user-posted content, the website disclaims all liability.
• The user will be permanently removed from the classified listing if a copyright or infringement concern arises. No discussion will be held regarding the action, which will be carried out in accordance with the Information Technology Act 2000.
• The website www.Webvyapar has the authority to take any action to resolve any discrepancy between the terms of the paid services and the terms of the agreement. If the problem persists, the paid services will still be in charge.
• Webvyapar has the right to amend the terms and conditions of the website. They will be published on the website once they have undergone revision and approval. There is no other way to change the terms other than in writing.
• Users can apply for membership on the website. The user's request for registration is activated in two business days. The length of time depends on the requested activation duration.
• In the event of any loss of data or hacking, the website cannot be held responsible because the servers are owned by a third party. To ensure security, the conversation can be stored and backup offline. In any way, Webvyapar is not liable for the security or safety of information.
• The owners of the website have the right to revise the membership fees at their discretion.
• The company Webvyapar has the right to deactivate and go offline at any time without any justification to its users.
• During the membership registration process, the user can choose their preferred method of communication. This can be done via calls, SMS, emails, etc.

1. For all Users

• No part of the website's resources or content is used for the purpose of reselling or redistribution. Users are limited to using website resources for personal use only. Users are not allowed to advertise a company that competes with Webvyapar.
• All users are restricted from violating the intellectual property rights of other users or third parties in any way through the use of Webvyapar's services. Accounts of users or members who attempt to violate copyrights or intellectual property rights once will be directly terminated by Webvyapar. Webvyapar reserves the right, in its sole discretion, to terminate a user's account for any single instance of violating another party's rights while using the service, or if Webvyapar believes that the user's actions are prejudicial to the interests of Webvyapar, its affiliates, or other users.
• Webvyapar periodically updates its website features to provide the best services. Webvyapar reserves the right to add, remove, or modify any portion of a feature from the website at any time and from anywhere, without giving prior notice by simply updating the feature's description. The members' or users' confirmation or consent won't be necessary for the application of the same. No requests for changes/modifications to the applicable changes will be considered.
• Users may encounter third-party content on the website, as Webvyapar also displays content posted by third parties. By virtue of their content being displayed on the website, neither Webvyapar nor any of its employees, associates, officers or directors act as sales agents for a third party. Webvyapar shall not be held liable for any Third-Party Content's accuracy, lawfulness, authenticity, or truthfulness. Webvyapar is not responsible for liability to any person in connection with any damage suffered by that individual.
• In order to ensure the security and appropriate use of the user's information in a possession, Webvyapar recommends its users to read and comprehend the privacy policy carefully. By using the website, each user agrees to the privacy statement and any required updates or modifications made on the website. Users of Webvyapar must agree with the privacy statement posted on the new version of the website. Users are advised to regularly check for new privacy policy updates. To continue the use of the website, users are deemed to have accepted the privacy statement.
• Webvyapar maintains the right to grant, deny, or restrict access to the website for different users and to change or add features (whether new or existing) without prior notice. Each user acknowledges that the business may suffer if they are denied access to use the website (completely or partially). Any delays in communications or transmissions, errors or omissions with respect to any communications or transmissions, or any other damages (direct, indirect, subsequent, or otherwise) resulting from the use or inability to use the website or any other feature of Webvyapar shall in no event be the responsibility of the User or any third parties.
• The content, goods, and services offered by third parties are accessible to users of Webvyapar via hyperlinks (in the form of banners, word links, channels, or other forms of their websites). Before using or providing any type of information, Webvyapar advises its users to carefully read and comprehend the terms and conditions and privacy policy of the websites. The user agrees that Webvyapar has no control over the websites of third parties, doesn't monitor those websites, and is not responsible for the information, goods, or services that are advertised there.

Note: After 365 days from commencing the date of receipt, the inquiries will be automatically deleted/removed from the folder.

2. For Registered Users

• Each registered user must first complete an online registration form (which may include details such as name, address, contact information, fax number, residential address, email address, and information about their business) and then create an account with Webvyapar (to become a registered User). Each registered user is given a login name (also known as a unique username or user ID), a password, and access to their account.
• As a registered user, the person grants Webvyapar permission to store and share their personal information in our global manufacturer, buyer, and seller database.
• If the registered user is a commercial entity; the company agrees, represents, and warrants that:
• You are in possession of the power necessary to bind that entity to this Agreement;
• The address you provide during registration is the entity's principal place of business; and
• Every other piece of information you give Webvyapar while registering is true, up-to-date, accurate, and comprehensive. The principal place of business will be regarded as the head office for the purposes of this clause; neither a branch nor a representative office shall be regarded as a separate entity.
• Webvyapar can give users an email account with a small amount of cloud storage to use for receiving and sending emails. Users are solely responsible for the messages they send and receive, as well as any consequences that may arise. Webvyapar will never be held responsible for the defamatory, harassing, or spam content of any emails exchanged.
• If a user decides to part ways with Webvyapar, the user can delete or remove their account by completing the delisting process through the "Remove Account" option in "My Folder."
• Webvyapar reserves the right to refuse any user access to membership services, email accounts, user IDs, and passwords without providing a reason.
• Every registered user grants Webvyapar right to use the user's copyrights if necessary or in the case of leads posted by other users.
• The registered user will no longer be anonymous to the website after registering with Webvyapar. Registered users hereby grant Webvyapar permission to display and publish the necessary and desirable information from, including but not limited to, the user's business brochures, website, business directory, trade leads, or any related document.
• The URLs provided to users are solely under the control of Webvyapar, and they may be modified, removed, or edited at any time without prior notice. Webvyapar is not responsible for any indirect losses caused by these adjustments.
• To enhance users’ experience, Webvyapar offers a Primary Number of services to paid subscribers. Users are allowed to contact the person who generated the lead if they miss the call regarding business leads so users don't lose out on potential clients.
• As a registered user, the user must agree that all divisions, sister companies/ventures of Webvyapar, as well as other portals and websites, including Third Party Service Providers and Search Engines, may list, display, and use your information for the purpose of marketing user’s online business.
• Without Webvyapar's prior written consent, a registered user may not give, assign, sell, try to sell, or otherwise transfer an Account, User ID, and password to a third party. In the event of a sale, gift, transfer, assignment, or other disposition of the aforementioned items, Webvyapar retains the right to cancel the accounts of both the individuals on the buyer and seller’s end.
• Webvyapar reserves the right to suspend or terminate a registered user's account at any time by providing the user with at least 24 hours notice. As long as, the notice is not necessary if:
• Webvyapar suspects that the user's actions may result in legal liability/financial loss to the user, other users, Webvyapar, or its affiliates. Webvyapar has sufficient evidence to demonstrate that the data supplied to it is inaccurate and out-of-date
• The registered user has violated any of the terms of this agreement.
• Registered users are not permitted to use the email account provided by Webvyapar to exchange material/information that is considered abusive/unlawful/harassing/libelous/vulgar/threatening/harmful/obscene/otherwise objectionable material of any kind. Furthermore, they are not permitted to use the email account for junk mail, spam, or chain letters.
• The Registered User shall not publish, distribute, transmit, or circulate unsolicited advertising or promotional messages, or content that is obscene, indecent, seditious, defamatory that results in discrimination, threats, or infringements.

3. For Users Publishing Content on Webvyapar

• A person must be a registered user in order to post any type of information on Webvyapar. Registered users may post the information using the various function tools provided by Webvyapar.
• In accordance with the sanctions imposed by the UN, UK, USA, EU, and/or any other government and/or regulatory body, Webvyapar does not accept registrations from or transactions from any member/user who is directly or indirectly involved with sanctioned countries/territories (like- North Korea/Democratic People's Republic of Korea, Iran, Crimea, Cuba, Sevastopol/Crimean Autonomous Republic, and Syria).
• Users agree that by posting information on the website, buyers and sellers may contact them via phone calls, SMS, WhatsApp, or by mail for the purpose of conducting business. The inquiries may or may not be pertinent to the user's business. When users send business inquiries to registered members via Webvyapar, the website has no responsibility over these inquiries and won't get involved in any further investigations.
• If a user submits any information to Webvyapar that is considered defamatory, Webvyapar has the right to take action against the user.
• Users must make sure the following when posting content to the website:
• To offer real, up-to-date, and accurate data for display on the website.
• to periodically update the information as needed.
• A user must possess all necessary trademarks, Copyright, and material rights to submit any content or posts to the website.
• Webvyapar is only in charge of displaying the goods and services offered by the listed suppliers in the pharmaceutical and cosmetic industries; it does not promote the purchase or sale of these goods and services directly.
• All users agree to be bound by and comply at all times with all rules and laws, orders, and notifications issued by the Indian government and its authorities, including buyers and sellers of pharmaceutical and cosmetic goods and services.
• The content, images, information, or any other data pertaining to chemicals, medications, or medicines is not under Webvyapar's control; as a mediator, we are merely giving Suppliers a platform to showcase their goods and services.
• In accordance with the Schedules of the Drugs and Cosmetics Act, 1940, as amended, suppliers of prescription medicines and/or drugs hereby agree to be fully accountable for and bear all liabilities arising out of the sale or purchase. The Suppliers further declare that they are entirely liable for any violations of any kind and that they have full authorization, ownership, dealership, and selling rights.
• The website only serves as a platform for advertisements; it does not act as an agent for either the buyer or the seller in specific business dealings. The quality, safety, legality, or availability of the goods or services offered for sale on the website, as well as the suppliers' and buyers' capacities to complete transactions, are not under the control of the website and are not its responsibility. If the User sells or buys drugs or medicines illegally, Webvyapar, its directors, affiliates, officers, and employees are indemnified and held harmless for any losses or liabilities resulting from that action.
• No information regarding medications, drugs, or chemicals listed in Schedule X of the 1940 Drugs and Cosmetics Act or its Amendments will be posted. If Webvyapar receive a complaint, directive, or mandate against any content or listings, the website reserves the right to remove it immediately and without prior notice. Suspension of membership may follow a violation of Indian law.
• Webvyapar reserves the right to remove or prohibit any information or material posted on the website that is logically determined to be unlawful, or inappropriate that violates this agreement. In the event of a suspicious/fraudulent crime or other wrongdoing, Webvyapar agrees to provide the government, law enforcement personnel, private investigators, and/or affected third-party/parties. In the same way, Webvyapar is permitted to reveal a user’s identity and contact information if that disclosure is required by law enforcement, or affected parties, as a result of legal action. Webvyapar is not responsible for the disclosure or any damages or outcomes that may result from it, and the User agrees not to sue the company as a result of such a disclosure. If any of the aforementioned occurs, Webvyapar retains the sole authority to suspend or terminate the user's account. Users agree that Webvyapar is not liable to them for taking any of the actions mentioned in this Section, including no liability for consequential or actual damages, and that they accept the risk to which Webvyapar may resort.
• By providing information to Webvyapar and displaying it on the website, the User hereby acknowledges that the user is solely responsible for all content posted on the website. It must not infringe on the rights of any third parties and must have the owner’s consent before being posted. Each user hereby acknowledges, represents, and warrants that the user has the legal right to manufacture, sell, import, and distribute the goods and services posted and displayed on the website, and such manufacturing, sales, importing, and distribution does not infringe upon the rights of any third party.
• Users who sign up for paid services or special offers may occasionally be given free leads. No user may hold Webvyapar liable for the distribution of leads in any way because it depends on availability. Buyers post leads, and the delivery of those leads depends on trends, popularity, the time of year, the type of product, and other factors. Webvyapar cannot guarantee the receipt of leads because it is not in charge of such matters. In its best efforts, Webvyapar tries to forward leads that are pertinent to the user's products and services, but it is not responsible for the leads' accuracy or legitimacy.
• The User acknowledges that Webvyapar's role is limited to the integration of some services involving Third Party Service Providers, such as Payment Gateway Integration, and that all subsequent support and issue resolution is wholly the User's responsibility. A User cannot, under any circumstances, hold Webvyapar accountable for Third-Party service delays, failures, or disruptions.

4. Access to the Website

Users' access to the website will be restricted in the following activities:

• If third parties unlawfully gain users’ data.
• User violates the rights of third parties by creating, importing, distributing, offering, displaying, purchasing, reselling, and/or using the goods or services they see on the website.

5. Intellectual Copyright and Its Violation

• The Logos, Registered marks, and Trademarks are the intellectual property of Webvyapar or its partners or affiliates. As a result, all rights are transferred to the associate and affiliates' websites. It is strictly prohibited to retain, reuse, reproduce or publish the contents or a portion of contents in any format, without written consent.
• Nothing on the website should be interpreted as offering any licence or permission to use any trademark represented on Webvyapar, whether implicitly, explicitly, or in any other way.
• The content of the website cannot be used in any misleading or objectionable context.
• The user may not, and may not authorise any third party to, perform any of the following:
• access or monitor any material or information on Webvyapar system using any manual process or robot, spider, scraper, or other automated means;
• copy, reproduce, alter, modify, create derivative works, publicly display, republish, upload, post, transmit, resell or distribute in any way material or information from Webvyapar;
• permit any third party to use and benefit from the Service via a rental, lease, timesharing, service bureau, or other arrangements;
• transfer any rights granted to you under this Agreement.
• Any breach of the above would be deemed an offense and would result in legal action under Indian law.

6. Website Designing Services

To maintain an engaging and error-free interface between customers, website design is one of the services that must be updated and these services are included in the membership. There is no additional charge for the maintenance of these sites. Webvyapar have the sole right to maintain its technical operation. Technical errors that occur during the uploading or hosting of the website cannot be used as grounds for litigation.

7. Notification related to the Development of Website Design Services

Regarding the information/materials needed for the website development, users will get a call/email from Webvyapar. A final letter of reminder will be sent to users if users fail to receive calls or mail and don't send the required information or materials.
In the event that users fail to provide Webvyapar with the information or materials required for the development of the website, the agreement regarding website designing services will be immediately terminated. After that, there would be an additional charge for any reactivation of website design services.

8. Website Hosting

After the website is developed, users are given temporary links. Users can propose for any modification or changes within five days of receiving the link through email. If Webvyapar doesn’t receive any requested mail regarding the changes or modifications to the website, Webvyapar will consider it as the user’s approval and host the user’s website on the domain. If requested earlier in writing, the stated number of days is subject to change.
Payment and Refund

Webvyapar believes in complete transparency and maintaining a thoroughly accountable system. At our discretion, if Webvyapar believe that if a user is abusing the refund policy, Webvyapar reserve the right to ban the account and restrict all future use of our Services.

9. Right to Terminate

Webvyapar may terminate this Agreement and close the user Account for any reason or no reason at any time upon notice. Webvyapar may also suspend the Service if the user:
(a) have violated the terms of Webvyapar, Platform's policies, or this Agreement,
(b) pose an unacceptable credit or fraud risk, or
(c) provide any false, incomplete, inaccurate, or misleading information or otherwise engage in fraudulent or illegal conduct.
If the agreement is terminated, the user will no longer be able to access the free or paid services offered by Webvyapar, and they will not be able to re-register using new User information unless Webvyapar gives their written consent. Additionally, in the event that the contract is terminated, no reimbursement of the membership fee or subscription price will be performed. Any direct or indirect loss resulting from the agreement's cancellation is not the fault of Webvyapar.

10. Legal Jurisdiction

The laws of the Republic of India shall govern any dispute arising from the use of this website, its products, and services; and the courts in New Delhi, alone shall have exclusive jurisdiction to deal with such matters.

11. Disputes

If a dispute of any kind arises, Webvyapar want to understand and address your concerns quickly and to your satisfaction. Please contact Customer Support with any dispute. If we cannot resolve your concerns, we agree to an informal dispute resolution process requiring individual arbitration. In the unlikely event that one or more provisions of the agreement are found to be unenforceable, the other provisions shall remain in full force and effect.

12. Updating These Terms

From time to time, Webvyapar may update these Terms to clarify the practices or to reflect new or different practices (such as when Webvyapar add new features), and Webvyapar reserves the right in its sole discretion to modify and/or make changes to these Terms at any time.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.

13. Users Acceptance of these Terms

By using this website, users signify their acceptance of these terms. If users do not agree to this policy, please do not use the website. Users to continue the use of the website following the posting of changes to this policy will be deemed users acceptance of those changes.

14. After paid Services User go to sign in option and retrive the password  to their mail id once  new password created sign in the member folder and start accessing the available leads this is user self resposiblity to create their login nobody from 24 digital india have rights to share the manually passwords or login client member folders without clients written permission member have to manage their member folder like add or remove products etc. Once the user add the similar name and image to the product in which looking for the leads the same lead  started accessing.

15.  Our package is already designed if any extra pages or images then customer have to upgrade for their membership without upgrade we cannot add extra images or pages for add on things client have to pay the amount after discussion with sales team and  once client approve for their layout and once website live then also on add-on changes we will take extra amount.
